Terms of Use
1. Acceptance
By downloading or using Somatic ("the App"), you agree to these Terms of Use ("Terms"). If you do not agree, do not use the App. These Terms are an agreement between you and Ruckus Labs, LLC ("we," "us," or "our") and are governed by the laws of the United States.
2. License
Subject to these Terms, we grant you a personal, non-exclusive, non-transferable, revocable license to use the App on Apple devices you own or control, for your personal, non-commercial use. You may not copy, modify, distribute, sell, or sublicense any part of the App.
3. Health and fitness disclaimer
Somatic is a workout tracking tool and is not a medical device. Nothing in the App constitutes medical advice, diagnosis, or treatment. Heart rate monitoring, calorie estimates, pace calculations, and AI-generated workout suggestions are for informational purposes only and may not be accurate for all users.
Consult a qualified healthcare professional before beginning any new exercise program, especially if you have any medical conditions, injuries, or health concerns. You assume all risk associated with your physical activity. Ruckus Labs, LLC is not responsible for any injury, illness, or adverse outcome resulting from use of the App or reliance on information it provides.
4. Purchase and refunds
Somatic is available as a one-time purchase through the Apple App Store. All purchases are processed by Apple and are subject to Apple's purchase terms and refund policies. We do not process payments or issue refunds directly. For purchase-related issues, contact Apple Support.
5. Acceptable use
You agree not to use the App to:
- Violate any applicable law or regulation
- Attempt to reverse-engineer, decompile, or extract the source code of the App
- Interfere with or disrupt the App or any associated systems
- Use the App for any commercial purpose without our prior written consent
6. Intellectual property
The App — including its design, code, graphics, and content — is owned by Ruckus Labs, LLC and protected by copyright, trademark, and other applicable intellectual property laws. These Terms do not grant you any rights to our intellectual property except for the limited license described in Section 2.
7. Third-party services
The App integrates with Apple Health, Apple Maps, and Apple's on-device AI framework. Your use of those services is governed by Apple's own terms and privacy policies, not ours. We are not responsible for the practices of Apple or any other third party.
8. Disclaimer of warranties
The App is provided "as is" and "as available" without warranties of any kind, express or implied. We do not warrant that the App will be uninterrupted, error-free, or free of harmful components. To the fullest extent permitted by applicable law, we disclaim all warranties, including any implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
9. Limitation of liability
To the fullest extent permitted by applicable law, Ruckus Labs, LLC and its officers, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages — including any loss of data or personal injury — arising out of or related to your use of or inability to use the App, even if we have been advised of the possibility of such damages.
Our total liability to you for any claims arising from use of the App shall not exceed the amount you paid for the App in the twelve months preceding the claim.
10. Governing law and disputes
These Terms are governed by the laws of the United States, without regard to conflict-of-law principles. Any dispute arising from these Terms or your use of the App shall be resolved through binding arbitration or in a court of competent jurisdiction in the United States, at our election.
11. Severability
If any provision of these Terms is found to be unenforceable, that provision will be modified to the minimum extent necessary to make it enforceable, and the remaining provisions will remain in full effect.
12. Changes to these Terms
We may update these Terms from time to time. Changes will be posted at this URL with an updated date. Continued use of the App after changes are posted constitutes your acceptance of the updated Terms.
